Terms and Conditions of Use

1. Definitions and scope

These Terms and Conditions of Use ("Terms") govern access to and use of the AIFLUX platform ("Service"), operated by AIFLUX (trade name of ForgeAISolution) ("Owner", "we") — VAT no. IT14088920963, Via Derna 28, 20132 Milano (MI), Italy, [email protected].

By using the Service, the user ("User", "you") fully accepts these Terms. If you do not accept them, do not use the Service.

2. Description of the Service

AIFLUX is a platform that enables the generation of images and videos through artificial intelligence models. The Service includes:

• Image generation from text (text-to-image) and from images (image-to-image).
• Video generation from text and from images.
• Motion control for videos.
• Personal gallery to view past creations.

3. Registration and account

• To use the Service, you must create an account by providing a username, a valid email address, and a password.
• The User must be at least 18 years old (the age of majority). The Service may generate, at the User's request, content intended for an adult audience; therefore, access is restricted exclusively to adults.
• Age verification: access to adult (18+) content requires verification of age through our third-party provider Yoti (document scan), in compliance with AGCOM Resolution 96/25/CONS. A self-declared date of birth is not sufficient. Until verification is completed, access to such content and certain features is restricted (see Section 6b).
• The User is responsible for the confidentiality of their credentials and for all activities carried out through their account.
• Creating multiple accounts, using false identities, or sharing credentials with third parties is prohibited.
• We reserve the right to suspend or delete accounts that violate these Terms.

4. Credit system and payments

• Use of the Service requires credits, which can be purchased through the platform.
• Payments are processed securely by Stripe, Inc. AIFLUX does not store credit card data.
• Purchased credits are non-refundable, except as required by applicable law.
• Right of withdrawal (consumers): under the EU Consumer Rights Directive 2011/83/EU and the Italian Consumer Code (Legislative Decree 206/2005), a consumer ordinarily has 14 days to withdraw from a distance purchase. Credits are digital content supplied immediately: before completing payment you are asked to expressly consent to their immediate provision and to acknowledge that, once the credits are made available to your account, the right of withdrawal for that purchase is lost (Art. 59(1)(o) Consumer Code · Art. 16(m) of the Directive). Purchases for which you have given this consent are therefore final, except as otherwise required by applicable law.
• Credits do not expire, but are forfeited if the account is terminated for violation of these Terms.
• Prices may be changed with 30 days' notice. Credits already purchased retain their value.

5. Generated content and intellectual property

• Content generated through the Service (images, videos) is created using third-party AI models.
• The User may use generated content for personal and commercial purposes, in compliance with applicable laws and third-party rights.
• AIFLUX does not claim any ownership rights over content generated by the User.
• The User is solely responsible for how they use the generated content.
• The "AIFLUX" trademark, logo, and platform design are the exclusive property of ForgeAISolution.

5b. User inputs and data retention

• When the User uploads input files (images, videos, audio) for content generation, such files may be temporarily stored on our servers to enable features such as generation repeat ("Repeat") and Service improvement.
• Input files are stored in encrypted form on secure cloud infrastructure (Cloudflare R2) and are accessible only by the User who uploaded them.
• Input files are automatically deleted when the User deletes the associated generation from their gallery, or upon account deletion. The User has full control and can delete their data at any time.
• The User retains all rights to their input files. AIFLUX does not use input files to train AI models or for any purpose other than providing the Service.
• The User must not upload files containing sensitive personal data of third parties without their consent.

6. Prohibited uses

It is strictly forbidden to use the Service to:

• Generate child sexual abuse material or content depicting the sexual exploitation of minors (CSAM).
• Create non-consensual deepfakes or content that violates the dignity of real persons.
• Generate content that incites violence, terrorism, racial hatred, or discrimination.
• Infringe upon the intellectual property rights of third parties.
• Generate spam, phishing, or fraudulent content.
• Attempt to gain unauthorized access to the Service, computer systems, or other users' data.
• Use the Service for activities that are illegal under applicable law.

Violation of these rules will result in immediate suspension of the account and reporting to the competent authorities where required by law.

6b. Age verification and content moderation

• Adult (18+) content is available only to users who have completed third-party age verification (Yoti). A self-declared date of birth is not sufficient.
• To protect minors and comply with the law, media uploaded or generated by users who have not completed age verification is automatically screened by an AI content-moderation system. Disallowed inputs prevent the generation from starting; disallowed outputs are withheld and not displayed. You can lift these restrictions at any time by completing age verification.
• You may request human review of a moderation decision by writing to [email protected].
• The detection or upload of child sexual abuse material results in immediate account termination, preservation of the material in restricted storage, and reporting to the competent authorities as required by law.

7. Service availability

• The Service is provided "as is" and "as available".
• We do not guarantee that the Service will be uninterrupted, error-free, or that results generated by AI will be accurate or suitable for any specific purpose.
• We reserve the right to suspend or discontinue the Service, in whole or in part, for maintenance or other reasons, with advance notice where possible.

8. Limitation of liability

To the extent permitted by law:

• ForgeAISolution shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Service.
• ForgeAISolution's total liability to the User shall not exceed the total amount paid by the User in the preceding 12 months.
• The User is solely responsible for the generated content and its use.

9. Suspension and termination

• We reserve the right to suspend or terminate the User's account in the event of a violation of these Terms.
• The User may delete their account at any time by contacting us via email.
• Upon account deletion, User data will be removed within 30 days, except where retention is required by law.

10. Changes to the Terms

We reserve the right to modify these Terms. Changes will be communicated with at least 15 days' notice through the Service or by email. Continued use of the Service after the effective date of the changes constitutes acceptance of the new Terms.

11. Governing law and jurisdiction

These Terms are governed by Italian law.

For any dispute relating to the interpretation or performance of these Terms, the competent court shall be the Consumer Court pursuant to Art. 66-bis of the Italian Consumer Code (Legislative Decree 206/2005), i.e. the court of the place of residence or domicile of the consumer User.

For disputes with professional users, the court of the Owner's place of residence shall have jurisdiction.

Nothing in these Terms shall affect any mandatory consumer protection rights that you may be entitled to under the laws of your jurisdiction of residence.
